Kaspersky Lab announces the results of the judicial proceedings with its distributor partner in Benelux

Kaspersky Lab, a leading developer of secure content management solutions, announces the results of the judicial proceedings with its distribution partner in Benelux.

Due to systematic breaches of its contract obligations by Kaspersky Lab Benelux, including royalties’ payment liabilities default for 2008 and 2009, a number of recriminatory complaints arose between Kaspersky Lab and said partner. After two years of vain efforts to convince the distribution partner to fulfill the contract terms, Kaspersky Lab intended to terminate the relationship with Kaspersky Lab Benelux. To settle the issue both companies took legal action. The summary proceedings court session took place 25th of January 2010 in Hertogenbosch, the Netherlands.

The court decision under summary proceedings was adjudicated 22nd of February 2010 appealing Kaspersky Lab Benelux to furnish a bank guarantee for the debt amount to Kaspersky Lab for unpaid royalties. Till present the guarantee wasn’t granted hence the court rejected the claims of Kaspersky Lab Benelux to lift the levied attachments on its bank account.

Kaspersky Lab obligations before Kaspersky Lab Benelux include the distribution agreement prolongation until August 1st 2010 on the initial conditions.

“Kaspersky Lab has already resumed the supply of codes and licenses”, says Andreas Lamm, Managing Director of Kaspersky Lab Europe. “All the terms of the court decision are being accurately fulfilled by Kaspersky Lab and we expect Kaspersky Lab Benelux to strictly follow these terms too”.

Despite the court decision obliging both companies to prolong the cooperation and strictly follow all the contract regulations, Kaspersky Lab Benelux still didn’t start to fulfill its obligations to Kaspersky Lab in terms of reporting on its operations and royalty payments.

Upon completion of the agreement period with its distribution partner, Kaspersky Lab will continue its operations in Benelux directly. All licenses sold by Kaspersky Lab Benelux will retain their current validity after August 1st 2010 and will be fully supported and maintained by Kaspersky Lab. Technical support and maintenance will be provided by the offices in Germany, France and the United Kingdom. Distributors, resellers and customers will continue to receive products and services. Customers will be fully supported in their local languages by Kaspersky Lab. Resellers will be supported by their distributors as usual.
